Business Mediation is on the rise but why is that? Well Business Mediation is increasingly being used due to a reluctance for businesses to get involved in protracted legal disputes. Increasingly businesses have turned to Mediation and the pandemic has certainly increased this with tensions and emotions being high for employers and employees. Another reason for choosing Mediation as opposed to Court proceedings is that it can be considerably more cost effective and can lead to more productive and amicable conclusions.

Leading Leicester law firm, Dodds Solicitors share with us everything you need to know about Business Mediation.

WHAT IS BUSINESS MEDIATION?

Business Mediation is an affordable and efficient means of problem-solving between two disputing parties. Cooperation, rather than conflict, is the sole focus of the process and to aid with this, parties meet in a neutral setting with an impartial mediator present.

From there, the mediator will help to consider the issues and options with the parties to reach an agreement. After the dispute is settled, both parties can sign documents agreeing to the outcome.

WHEN WOULD YOU USE BUSINESS MEDIATION?

Do you have an issue with another company that you work with?

Do you have an employee that you need assistance to deal with and come to a mutual agreement?

Are you a divorcing couple that share a business?

Examples of successfully mediated disagreements include:

Contract disputes

Financial disputes

Insurance disputes

Intellectual property (IP) disputes

Tax disputes

WHAT CAN YOU EXPECT AT MEDIATION?

If two businesses wish to mediate, they must agree to appoint an independent mediator. The mediator will not take a view as to the merits of the parties position but will remain independent and try to guide the parties involved to an agreed solution that works for all the parties involved.

Mediation can either take place face to face (subject to government restrictions) or by way of an online meeting. The mediator will meet with each party in turn and may have a meeting with both parties together if everyone agrees.

From there you can expect business mediation to follow this structure:

Introduction: the mediator will explain the rules and the mediation process to each party.

Statements by parties: a representative from each party is allowed the opportunity to describe the dispute.

Identification of the dispute: the mediator will ask questions in turn to better understand the situation.

Private meetings: the mediator invites each party to a private meeting to better understand their perspective of the dispute and to assess possible solutions.

Negotiation: the mediator will assist the parties to reach an agreed solution.

Written agreements: When the parties reach a resolution the parties then draw up a written document to reflect the agreement which has been reached.

WHY USE BUSINESS MEDIATION?

With the aid of an impartial mediator from Dodds Solicitors, we can work together to come to a solution for both parties. One of the big benefits of mediation is that that it can resolve disputes much more quickly than court proceedings and it means that as the parties have both worked together to produce a solution it may be possible for them to do business together in the future which would be an unlikely outcome after going through expensive and costly court proceedings.

Mediation could provide a workable solution for example where a building contract has been partially completed and agreement needs to be reached regarding how the project can be completed and what payment could be made or between two employees who struggle to work together due to clashing personalities or where one party wants to buy out another party who is leaving a business partnership.

WHAT OUTCOMES CAN YOU EXPECT FROM MEDIATION?

No matter what the problem, whether it is a contractual or financial dispute, business mediation aims to resolve the issue to the satisfaction of each party. The mediation process usually takes place over a single day and in most cases leads to an agreement being reached between the parties.

This is a binding agreement and can be upheld in court.

For all your Business Mediation needs please contact Ashwin Topiwala who is an accredited Civil and Commercial mediator with the ADR group on 0116 2628596 or by email at ashwin.topiwala@dodds-solicitors.co.uk

The team at Dodds Solicitors share with DLUXE the rich history from the last four decades, their legacy and what they’re looking forward to in the near future.

Starting out as Marron Dodds, the firm quickly established a national reputation for Planning Law and acted for several well-known building firms. A few years later, in 1986, the firm merged became Marron, Dodds & Waite in 1986 with Peter Marron, Brian Dodds and John Waite as Senior Partners and Steve Morris joined as a Partner. John Waite later went on to join Spearing Waite leaving Peter and Brian as a Commercial, Criminal and Family firm.

As the firm grew larger, around 1994, Brian Dodds and the criminal and family department moved to 24 Friar Lane while Peter Marron and his commercial team stayed at 31 Friar Lane. Subsequently, Peter and his team later moved to new offices, out of the city centre and closer to the motorway at the Meridian Business Park.

In 1999, Marron Dodds de-merged and Dodds became Dodds & Partners and moved to 32 Friar Lane where we have since remained. To celebrate the newly named Dodds & Partners the Dodds annual summer barbeque was born, which has been held every year since and remains a big night on the Dodds calendar for staff, partners and business contacts.

In 2011 to refresh the Dodds brand, ‘Solicitors’ was added to the firm’s title and became Dodds Solicitors LLP. Dodds Solicitors takes its name from one of its founding Partners, Brian Dodds, previously mentioned, who sadly passed away on 7th December 2005 after a brave and protracted fight against Motor Neurone Disease. On Brian’s death, Steve Morris became a Senior Partner.

Brian qualified as a Solicitor in 1974 after studying law at The University of Leicester. He is remembered amongst those who came into contact with him professionally as a fearless and persuasive advocate successfully fighting what others would see as lost causes. He specialised in representing children and young persons in Criminal and Care proceedings.

After his passing the Partners, Steve Morris (Crime), Manji Obhi (Care) and Ashwin Topiwala (Family) set up a memorial prize to honour Brian and recognise the contribution made by our late Senior Partner in the practise of criminal law to the best performing student in the crime exam at The University of Leicester where Brian himself studied. The Brian Dodds Memorial prize has now been sponsored since 2007 by the firm.

Dodds Solicitors has 52 employees across all departments who accumulatively have a whopping 536 years’ service! Dodds Solicitors have a saying that “we grow our own”, and this is why people stay out their careers with us. In a lot of cases we have taken on members of staff at either Legal Assistant or Paralegal level, guided them in the right direction to be offered a Training Contract, ultimately qualifying as Solicitors in their chosen field. We even have a history of a member of staff starting as a Legal Secretary and becoming a Partner! Of course this says a huge amount about the passion and determination of these members of staff, but also that through that qualification and ladder climbing process the Dodds family team gave all the encouragement and guidance possible for them to achieve their end goal.

Here at Dodds, we refer to our staff as the Dodds family and we call our management structure our family tree and treat each other like our extended family. This strength has been proven by the great communication we have kept going during lockdown and also the tremendous comments we received from our recent Lexcel Accreditation Audit stating we were “leaps and bounds above many other firms”. We gained our Lexcel Accreditation in 2018 which replaced the Solicitors Quality Mark required for Legal Aid to increase standards.

Also in 2018 we opened the doors to “The Mediation Centre” which offers mediation for a range of disagreements, including family and business mediation. If you want to know more about mediation and how it could work for you read Ashwin Topiwala and Sarah Spence’s article ‘Everything you need to know about mediation’.

We are a local firm, run by local people helping our community and this extends to the charities we work closely with. Over the years our list of chosen charities has grown and all of our charities are local to Leicestershire and connected with our line of work so that we can help to assist people beyond their legal issues. A list of the charities we support can be found on our website.

Before Covid hit, we were very excited to be attending the Leicestershire Law Society Annual Awards and Dinner as Steve Morris, Senior Partner, is shortlisted for ‘Solicitor of the Year’. Unfortunately due to the ongoing pandemic, it was postponed but is due to take place in September 2021 (fingers crossed!) With a career spanning over four decades we felt it would be a fitting tribute for Steve to be recognised for his years of commitment to Criminal Legal Aid work and his clients.

FOR FURTHER INFORMATION OR TO SPEAK TO A MEMBER OF THE TEAM PLEASE CONTACT DODDS SOLICITORS LLP ON 0116 262 8596 OR EMAIL ENQUIRIES@DODDS-SOLICITORS.CO.UK

The COVID 19 pandemic has meant that many of us have been faced with difficult situations with loved ones in hospital and in intensive care. I’m sure many of you have watched “Kate Garraway: Finding Derek” the heart-breaking story of her husband Derek’s yearlong battle with COVID, that has been made even more complicated by the lack of legal protection she and Derek had in place. Kate was unable to access funds to manage her husband’s care or refinance her mortgage. Sadly, she didn’t even have the legal right to see his medical notes owing to data protections laws.

Research by Solicitors For the Elderly shows that 65% of us think our next-of-kin will make medical and care decisions for us if we are no longer able to. In reality, this is not the case, unless a Health and Welfare Lasting Power of Attorney is in place. Currently only 22% of the UK have one in place, although there has been a rise of enquires made about Lasting Powers of Attorneys during the COVID pandemic.

To avoid this difficult and stressful situation a Health and Welfare Power of Attorney or Property and Financial Affairs LPA can give an Attorney, of your choosing ,the ability to act on your behalf. It can help to make a difficult situation easier for you and your loved ones. It is important to use a specialist lawyer who is experienced in this area of law and is trained to support people making these important, complex and difficult decisions. According to Which? 22,000 LPA’s are rejected every year, so it is important that you seek legal advice to make sure that yours is not one of the 22,000 rejected.

Here at Dodds Solicitors we are fully trained and highly experienced and specialise in all aspects of LPA’s, Wills and Probate. We pride ourselves on dealing with your case sensitively and professionally.

Making an LPA can be one of the most important things that you can do and we try to make our service as convenient and straight forward as possible. If you would like more information about Lasting Powers of Attorney or would like to arrange an appointment to discuss matters further please contact Susan Fletcher on 0116 262 8596.
