However thanks to a recent court decision there is more certainty that your wishes will be followed after your death. The law regarding inheritance Act Claims has recently been clarified following the recent Supreme Court decision in the case of Ilot v The Blue Cross and Others.
Heather Ilot made a claim in respect of her mother’s estate after her mother passed away and left all her money to charity. Heather had been estranged from her mother after leaving home at the age of 17.
The Court originally dealing with the matter awarded Heather £50,000 following a claim which she made. She appealed against the decision requesting more money and the various charities said she should receive less. The Court of Appeal awarded her £143,000 but this was then reduced by the Supreme Court to £50,000
