If you are leaving part of your property or money to your daughter or son in your Will or on intestacy and you pass away prior to them divorcing their spouse, what they inherit would be included within the matrimonial pot of assets to be split between them and their spouse on divorce. Not many parents would be happy with this situation. Contact our Wills and Probate Team to discuss making a Will which would protect your son or daughter’s inheritance in the event that they divorce from their spouse, subject to certain circumstances.
